Terms of Service

These Terms of Service ("Terms") are a contract between you and Swifthog LLC ("Swifthog," "we," "us," or "our"). They govern NORFED.info, forum.norfed.info, and related sign-in, email, and member features (together, the "Services"). "NORFED.info" is the public name of the collector site; Swifthog LLC operates the Services.

By using the Services, creating an account, or clicking to accept (where shown), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Important provisions

These Terms include sections that limit your remedies and expand your responsibilities, including Your content (license to Swifthog), Indemnification, Disclaimers, Limitation of liability, Member deals, and Disputes. Please read them carefully.

1. Eligibility and account

You must be at least 13 years old. If you are under 18, use the Services only with a parent or guardian who accepts these Terms for you.

You agree to provide accurate information (such as your email) and to keep it current. You are responsible for all activity under your account until you close it or notify us that it was compromised. Keep your sign-in credentials secure.

We may refuse, suspend, or terminate access at any time for violation of these Terms, risk to the community, or legal requirement.

2. Acceptable use

You agree not to:

  • Violate any applicable law or others' rights.
  • Post content you do not have the right to share (including photos, scans, or text copied from elsewhere without permission).
  • Harass, threaten, defame, or abuse others.
  • Spam, scrape, crawl for commercial or model-training purposes, or overload the Services.
  • Impersonate any person or misrepresent your affiliation with Swifthog or NORFED.info.
  • Upload malware or attempt to bypass security.
  • Use Buy / Sell / Trade to route payment off-site, post payment links or wallet addresses, or otherwise violate the pinned rules in that category.

We may remove content, restrict features, or cooperate with law enforcement when we believe it is appropriate.

3. Your content

You retain ownership of intellectual property in content you submit. These Terms do not transfer ownership to Swifthog.

You are solely responsible for your content. Do not represent that your posts are official statements of Swifthog or NORFED.info unless we authorize that in writing.

We are not obligated to store, publish, or provide copies of your content.

4. License you grant to Swifthog

To operate the Services and help collectors learn, you grant Swifthog a perpetual, irrevocable (except as below), non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify (for example crop, resize, transcribe, or excerpt), adapt, publish, display, perform, and distribute content you submit through the Services, including:

  • Operating the forum and member sign-in.
  • Using content on NORFED.info and related Swifthog channels (reference pages, articles, guides, newsletters, email, or social posts) for educational and documentary purposes about NORFED Liberty Dollars and related collectibles.
  • Creating derivative works for those purposes (such as illustrations based on your photos or quoted excerpts from your posts).

We will provide reasonable attribution (forum username, member name, or other credit you supply) when we reuse content on the main site, unless you clearly opt out in the post or ask us not to use a specific item.

Opt-out of specific content: Email [email protected] with links or descriptions of the content. We will use reasonable efforts to stop new publication on NORFED.info after we process a valid request. The license continues for copies already published, backups for a limited retention period, and quotes by other members on the forum.

Other users: Forum posts may be visible to others who might quote or reference them subject to forum software and these Terms. You agree that Swifthog is not liable if other users violate your expectations about reuse outside the Services.

5. Your representations

You represent and warrant that:

  • You own or control the content you post and have the right to grant the license in Section 4.
  • Your content does not infringe copyright, trademark, privacy, or other rights.
  • If your content depicts another person or their property, you have any permissions required to post it.

6. Moderation

We may review, edit, remove, or restrict content or accounts at our discretion, including for violations of these Terms, the pinned Buy / Sell / Trade rules, or applicable law. Moderators and staff are not liable for good-faith moderation actions to the maximum extent permitted by law.

7. Member deals (Buy / Sell / Trade)

The forum may allow members to post classifieds. Swifthog is not a party to any transaction between members. We do not hold funds, escrow items, authenticate numismatic pieces, or verify identity offline. Any deal is solely between the participants, at their own risk. If you believe content on the Services infringes your copyright, email [email protected] with:

  • Identification of the work and the material you claim is infringing (URL on the Services).
  • Your contact information and a statement of good-faith belief.
  • A statement, under penalty of perjury where applicable, that your notice is accurate and you are authorized to act.

We may remove or disable access to material and terminate repeat infringers when appropriate.

9. Privacy

Our Privacy Policy describes how we handle personal data. By using the Services, you also agree to the Privacy Policy.

10. Indemnification

You agree to defend, indemnify, and hold harmless Swifthog LLC and its members, managers, officers, employees, contractors, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your content or use of the Services.
  • Your violation of these Terms or applicable law.
  • Your violation of any third-party rights.
  • Any transaction or dispute with another member (including Buy / Sell / Trade).
  • Any use of your account, whether or not authorized by you, until you notify us of compromise.

Swifthog may control the defense and settlement of any matter subject to indemnification. You agree to cooperate. Swifthog will not settle any claim in a way that admits fault for you or imposes non-monetary obligations on you without your consent, where consent may not be unreasonably withheld.

11. Disclaimers

The Services are for information and community discussion about NORFED Liberty Dollars and related collectibles. We do not provide investment, tax, legal, or numismatic authentication advice. Content may contain errors. Verify important facts yourself.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that content will be accurate or complete.

Third-party services (hosting, email, payment processors used by members off-site) are not under our control. Your use of them is at your own risk and may be governed by their terms.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) No consequential damages. Swifthog and its suppliers, hosts, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or use, arising from or related to the Services or these Terms, even if we have been advised of the possibility.

(b) User and third-party conduct. Swifthog is not liable for content posted by members, for member-to-member transactions, for actions of other users, or for reliance on any post or reference material.

(c) Cap on direct damages. Swifthog's total aggregate liability for all claims arising from or related to the Services or these Terms is limited to the greater of (i) US $100 or (ii) the amounts you paid to Swifthog for access to the Services in the twelve (12) months before the event giving rise to the claim.

(d) Exceptions. Some jurisdictions do not allow certain limits. In those cases, our liability is limited to the fullest extent permitted by law.

Nothing in these Terms limits liability that cannot be limited by law (for example intentional misconduct where prohibited).

13. Release

To the extent permitted by law, you release Swifthog from claims and damages of every kind and nature, known and unknown, arising out of disputes with other users or third parties relating to the Services, including member deals. If you are a California resident, you waive California Civil Code Section 1542 to the extent necessary for this release to be effective (and otherwise waive comparable unknown-claims rights).

14. Feedback

If you send suggestions or ideas about the Services, you grant Swifthog the right to use them without restriction or compensation. Do not send confidential or proprietary feedback unless we agree in writing.

15. Termination

You may stop using the Services at any time. We may suspend or terminate access at any time. Sections that by nature should survive (including content license for material already published, indemnification, disclaimers, limitation of liability, release, and disputes) survive termination.

16. Disputes and governing law

These Terms are governed by the laws of the United States and the State in which Swifthog LLC maintains its principal place of business, without regard to conflict-of-law rules.

Except for claims for injunctive relief or intellectual property enforcement, you and Swifthog agree that disputes arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or Commercial Rules if you use the Services primarily for business). Arbitration will be in English, on an individual basis. You waive any right to participate in a class, collective, or representative action against Swifthog to the extent permitted by law.

Either party may bring qualifying claims in small claims court. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or prevent unauthorized access.

If a court finds the arbitration or class waiver unenforceable, exclusive jurisdiction and venue lie in the state or federal courts located where Swifthog LLC maintains its principal place of business.

17. General

If any provision is unenforceable, it will be modified to the minimum extent needed or severed. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Swifthog may assign these Terms to an affiliate or successor. These Terms are the entire agreement about the Services and supersede prior understandings on the same subject.

19. Changes

We may update these Terms. We will post the current version at this URL and update the date above. Material changes may be announced on the forum or by email. Continued use after the effective date of changes constitutes acceptance.
